Terms of service
These conditions of sale are entered into by the company WatchmakerFix SARL with a share capital of 1000EUR, whose registered office is located at 26 rue de la Chausee, 25500 MORTEAU, registered in the Besancon Trade and Companies Register under number 949 628 630 hereinafter referred to as “WatchmakerFix” and managing the website www.watchmakerfix.com and by any individual or legal entity wishing to make a purchase via the website www.watchmakerfix.com hereinafter referred to as “the buyer”.
Article 1. Subject
The present conditions of sale aim to define the contractual relations between WatchmakerFix and the purchaser and the conditions applicable to any purchase made through the internet site www.watchmakerfix.com. The acquisition of a product through this site implies unreserved acceptance by the buyer of these conditions of sale which the buyer acknowledges having read prior to ordering. Prior to any transaction, the purchaser declares, on the one hand, that the purchase of products on the www.watchmakerfix.com site is limited to strictly personal use and, on the other hand, that he/she has full legal capacity, enabling him/her to commit to these general terms and conditions of sale.
WatchmakerFix reserves the right to modify these conditions of sale at any time, in order to comply with any new regulations or to improve the use of its site. As a result, the applicable conditions will be those in effect on the date of the order by the buyer.
Article 2. Products
The products offered are those shown on the WatchmakerFix www.watchmakerfix.com site, while stocks last. WatchmakerFix reserves the right to modify the range of products at any time. Each product is presented on the website in the form of a description of its main technical characteristics. The photographs are as accurate as possible but are not binding on the Vendor. The sale of the products presented on the www.watchmakerfix.com website is intended for all buyers residing in countries that fully authorise the entry of these products into their territory.
Article 3. Rates
The prices shown on the product sheets in the internet catalogue are in Euros (€) and other local currencies. They include all taxes (TTC) for France and EU, taking into account the VAT applicable on the day of the order. Any change in the VAT rate may be reflected in the price of the products. The prices are excluding taxes for countries outside of European Union. WatchmakerFix reserves the right to modify its prices at any time, but it is understood that the price shown in the catalogue on the day of the order will be the only price applicable to the buyer. The prices indicated do not include delivery costs, which are invoiced in addition to the price of the products purchased, depending on the total amount of the order.
Article 4. Ordering and payment methods
Before placing an order, the buyer must create an account on the www.watchmakerfix.com website. The account creation section can be accessed directly from the menu bar. At each visit, the buyer, if he wishes to order or consult his account (status of orders, profile…), will have to identify himself using this information. WatchmakerFix offers the buyer the option of ordering and paying for products in several stages, with 2 payment options to choose from:
Payment By Bank Transfer:
The buyer selects the products they wish to order in the “basket”, modifies them if necessary (quantities, references, etc.), checks the delivery address or enters a new one. The shipping costs are then calculated and submitted to the buyer, along with the name of the carrier. The buyer then chooses the payment method of their choice: “Payment by bank transfer”. In the final stage, the buyer is asked to check all the information and to read and accept these general terms and conditions of sale by ticking the appropriate box, before confirming the order by clicking on the “Confirm my order” button. This final click constitutes the definitive conclusion of the contract. As soon as the order has been validated, the buyer receives an order form confirming that the order has been registered. In order to finalize payment and process the order, the buyer must contact his or her bank to transfer the amount of the order to the WatchmakerFix bank account, the details of which are communicated to the buyer. As soon as the transfer is received, the order will be processed and the buyer will be informed by e-mail. WatchmakerFix will ship the products at the earliest 2 working days after receipt of the transfer corresponding to the order, subject to provisions.
Secure payment by credit card:
the buyer selects the products they wish to order in the “basket”, modifies them if necessary (quantities, references, etc.), checks the delivery address or enters a new one. The shipping costs are then calculated and submitted to the buyer, along with the name of the carrier. The buyer then selects the payment method of their choice: “Payment by credit card”. The next step is to check all the information, read and accept these general terms and conditions of sale by ticking the appropriate box, and then confirm the order by clicking on the “Confirm my order” button. Finally, the buyer is redirected to the secure interface to enter their personal credit card details. If payment is accepted, the order is recorded and the contract definitively formed. Payment by credit card is irrevocable. In the event of fraudulent use of the card, the purchaser may demand that the card payment be cancelled, and the sums paid will then be credited back or refunded. The holder of a bank card is not liable if the disputed payment has been proven to have been made fraudulently, at a distance, without physical use of the card. To obtain reimbursement of the fraudulent debit and any bank charges that may have been incurred, the cardholder must dispute the debit in writing with his or her bank within 70 days of the transaction, or 120 days if provided for in the contract with the bank. The amounts debited will be reimbursed by the bank within one month of receipt of the cardholder’s written objection. The cardholder will not be charged any fees for the return of the sums.
Confirmation of an order implies acceptance of these terms and conditions of sale, acknowledgement that you are fully aware of them and waiver of your right to invoke your own terms and conditions of purchase. All of the data supplied and the recorded confirmation shall constitute proof of the transaction. If the buyer has an e-mail address and has provided it on the order form, WatchmakerFix will send an e-mail confirming that the order has been registered.
It is at the discretion of WatchmakerFix whether or not to accept the order. WatchmakerFix is not obliged to conclude a contract simply because an order has been placed. An order may be cancelled or rejected, for example, if a breach of these GTC has occurred or is suspected. This is the case, for example, if the buyer has not paid for a previous order or if the credit card balance for a previous order was insufficient. Cancellation of an order and refusal of future orders is also possible if the return rate for a customer is strangely high and does not improve despite notification to the buyer. Orders may also be cancelled if there is reason to suspect that the buyer is a commercial buyer and is unable to disprove this suspicion. In this case, future orders may be refused if it transpires that a buyer is reselling (or has been in the process of reselling) the goods ordered on a commercial basis. The buyer will be informed of the cancellation or refusal by email in each case.

Article 5. Reservation of ownership
WatchmakerFix retains full and Completee ownership of the products sold until full payment has been received, in principal, fees and taxes included.
Article 6. Withdrawal
In accordance with article L121-20 of the French Consumer Code, the buyer has a period of fourteen working days from delivery of their order to exercise their right of withdrawal and return the product to the seller for exchange or reimbursement without penalty, with the exception of the cost of returning the product.
Article 7. Shipping
Deliveries are made to the address indicated on the order form, which can only be within the agreed geographical area. Orders are placed by La Poste via COLISSIMO, a tracked delivery service, delivered without a signature. Delivery times are given as an indication only; if they exceed thirty days from the order, the sales contract may be cancelled and the buyer reimbursed. WatchmakerFix may provide the purchaser with a parcel tracking number by e-mail. The buyer is delivered to his home by his postman. If the buyer is absent, he will receive a notice of passage from his postman, which allows him to withdraw the products ordered at the nearest post office, during a period indicated by the postal services. The risks associated with transport are the responsibility of the purchaser from the moment the items leave the premises of WatchmakerFix. The purchaser is required to check the condition of the packaging and the contents of the merchandise upon delivery in the presence of the employee of La Poste or the delivery person. In the event of damage during transport, any protest must be made to the carrier within three days of delivery.
Article 8. Warranty
All products supplied by WatchmakerFix are covered by the legal warranty provided by articles 1641 et seq. of the French Civil Code. If a product sold is not in conformity, it can be returned to WatchmakerFix, which will take it back, exchange it or reimburse it. All claims, requests for exchange or refund must be made by email to the following address: info@watchmakerfix.com within 8 days of delivery. If no communication is received, the goods will be deemed to have been accepted.
Article 9. Responsibility
In the distance selling process, WatchmakerFix is only bound by an obligation of means. It cannot be held responsible for any damage resulting from the use of the Internet, such as loss of data, intrusion, viruses, disruption of service or other involuntary problems.
Article 10. Intellectual property rights
All elements of the www.watchmakerfix.com site are and remain the exclusive intellectual property of WatchmakerFix. No one is authorised to reproduce, exploit or use for any purpose whatsoever, even partially, elements of the site, whether in the form of photos, logos, visuals or text.
Article 11. Personal information
WatchmakerFix is committed to preserving the confidentiality of information provided by the buyer, which he or she may be required to transmit in order to use certain services. Any information concerning the purchaser is subject to the provisions of law n° 78-17 of 6 January 1978. Internet users therefore have the right to access, modify and delete information concerning them. Article 12. Dispute resolution
These conditions of distance selling are governed by French law. In the event of any dispute or litigation, the competent court will be that of Besançon, France.
Article 13. SMS use
By consenting to WatchmakerFix’s SMS marketing in the checkout and initializing a purchase or subscribing via our subscription tools, you agree to receive recurring text notifications (for your order, including abandoned checkout reminders), text marketing offers, and transactional texts, including requests for reviews from us, even if your mobile number is registered on any state or federal do-not-call list.
Message frequency varies. Consent is not a condition of purchase. If you wish to unsubscribe from receiving text marketing messages and notifications, reply with STOP to any mobile message sent from us or use the unsubscribe link we provided you within any of our messages.
You understand and agree that alternative methods of opting out, such as using alternative words or requests, will not be considered a reasonable means of opting out. We do not charge for the service, but you are responsible for all charges and fees associated with text messaging imposed by your wireless provider. Message and data rates may apply.
